Federal Communications Commission Deputy General Counsel (Administrative Law) in Washington, District Of Columbia

Summary The Office of General Counsel (OGC) serves as the chief legal advisor to the Commission. OGC also represents the Commission in litigation and adjudicatory matters, assists the Commission in its rule-making and policy-making capacities, and performs a variety of critical legal functions regarding internal agency administration. The Deputy General Counsel serves as one of the principal advisors to the General Counsel on the formulation of overall policies for the Administrative Law Division. Responsibilities This senior supervisory attorney position offers a unique opportunity to support the General Counsel of the Federal Communications Commission, to advise on a wide range of administrative law, general law, and other complex legal and policy matters that come before the Commission, to support and shape policies, and to offer creative solutions to thorny legal and procedural issues. The incumbent will serve as a Deputy General Counsel for Administrative Law and is a critical member of the Office of General Counsel with wide and varied duties to help best protect the agency’s interests, including: Serving as one of the principal advisors to the General Counsel in representing the Commission in general legal matters including informal advice rendered by the Administrative Law Division; Interpreting statutes and executive orders and handling legal matters affecting the Commission’s homeland security responsibilities and attending meetings where such classified information is discussed; Reviewing and participating in resolving complex legal questions in connection with the internal administration of the Commission, including labor relations matters and the Commission’s relationships with other departments and agencies, such as the Department of Justice, the Department of State, the Government Accountability Office, Federal Trade Commission, and the Department of Commerce; Monitoring program and policy initiatives of other bureaus and offices as well as other agencies, identifying possible duplication, inconsistencies, or conflicts, and, in coordination with the General Counsel, takes steps to resolve these issues; Providing managerial support in overseeing the Office of General Counsel, particularly its Administrative Law Division; and Providing executive personnel management of Division staff in accordance with Office of Personnel Management guidelines, Commission policies and procedures, and the Basic Negotiated Agreement. However, those applicants must address the following Mandatory Technical Competencies. MANDATORY TECHNICAL COMPETENCIES: All candidates must submit a narrative statement (as reflected in your answers to the Vacancy Questions or upload as a separate document) addressing each of the following Technical Competencies. Experience that demonstrates ability, knowledge and skill (1) in analyzing a wide range of communications, administrative, statutory, and/or constitutional law issues affecting the communications industry and federal regulatory practice governing the industry, and (2) in handling other complex legal and policy matters that require extensive, comprehensive and relevant knowledge of federal, state and/or local law and applicable court decisions, Comptroller General and other decisions on appropriations law, and related policies and procedures. Experience that demonstrates an ability to analyze and identify legal risks associated with complex regulatory actions and to draft and edit memoranda or other legal documents clearly and persuasively addressing those risks. Demonstrated knowledge of federal regulatory practice and administrative procedures, including but not limited to the communications field, and how legal, technical and policy issues are integrated in rulemaking and policy recommendations. Demonstrated knowledge and experience with the principles and practices as well as the administrative laws, regulations, and policies applicable to the administration of a federal agency in order to analyze and recommend improvements in management and operational policies and procedures. Experience in providing legal advice/counsel to senior leadership on controversial issues of the highest priority/visibility while coordinating, managing, and participating with internal and external teams to meet targets, achieve maximum productivity, and ensure effective service to the public. Education You must meet the minimum basic educational requirements for Attorney positions. Applicants must possess a law degree (J.D. or LL.B) from a law school accredited by the American Bar Association and be a member of the bar in good standing of a state, territory, the District of Columbia, the Commonwealth of Puerto Rico, or a federal court of general jurisdiction.
